  1. Trilogy Power Pools, LLC. ("Trilogy", “TPP” or "We") respects the privacy of the user (the “User or “You”) and we are committed to protecting your privacy through our compliance with this notice. This privacy notice describes the types of information we may collect from you or that you may provide when you visit the website trilogypowerpools.com (our "Website") or using the TPP Progressive Web App (collectively with the Website, the "Services") and our practices for collecting, using, maintaining, protecting, and disclosing that information.

    This privacy notice applies to information we collect:

    1. On this Website.
    2. Through the TPP Progressive Web App.
    3. ’Trilogy Power Pools’, TPP the Arizona limited liability company known as Trilogy Power Pools, LLC.
    4. In email, text, and other electronic messages between you and the TPP Progressive Web App and Website.
    5. Through mobile and desktop applications you download from this TPP Progressive Web App and Website, which provide dedicated non-browser-based interaction between you and the services provided on this TPP Progressive Web App and Website.

    It does not apply to information collected:

    1. By TPP offline or through any other means, including on any other website operated by TPP or any third party; or
    2. By any third party, including through any application or content (including advertising) that may link to or be accessible from or on the TPP Progressive Web App and Website.

    Please read this notice carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use the Services. By accessing or using this TPP Progressive Web App and Website, you agree to this privacy notice. This notice may change from time to time (see below- Changes to Our Privacy Notice). Your continued use of the Services after we make changes is deemed to be acceptance of those changes, so please check the notice periodically for updates.


  2. Age Verification
    To register to create an Account (“Account”) and use the Services, your age must be verified. You may be required to provide the details requested including but not limited to your name, date of birth, zip code, and address. You may also be asked to provide a picture of a government ID or scan the barcode on a government ID. TPP accepts current (non-expired) state driver's licenses from states where the Services are available. By creating an Account and providing your contact information and cell phone number on this Application, you agree to provide accurate and current information about yourself, and to maintain and promptly update your profile information in the event it changes (such as your address or e-mail address) after Account creation. You may modify your profile information by logging into your Account and making such changes or contact customer service at support@trilogypowerpools.com. Any information collected by TPP will be held subject to these Privacy Policy and "just-in-time" notices, if any, provided at the point of information collection or use. By creating an Account on this Application, you also agree to allow TPP to contact you via mail, email, autodialed calls or texts or through any other means necessary to verify and update your profile and order information, or collect additional information related to your Account.


  3. Compliance
    You will comply with all of the terms and conditions of this Agreement and all applicable laws, regulations and rules when you use the Service, including but not limited to those of your state of residence. Unless otherwise expressly noted, a User must be at least 21 years old to use or participate in the Service. We may offer this Agreement to Users of age 18 or older, subject to applicable state laws and our own discretion. This offer and these rules & policies are valid only where legal. You are responsible for ensuring that it is legal for you to use the Service in your local jurisdiction. TPP reserves the right to suspend a User’s Account if the user’s profile information is incorrect and / or in violation of any of the present Terms of Use and Service and /or in the sole judgement of TPP appears to be in breach of any applicable law. TPP reserves the right to cancel a User’s Account if that User’s conduct on or use of the Services is deemed disruptive, shocking to the conscience or unacceptable by TPP in its sole discretion. In the event of any state lottery ticket winnings due or paid to a trilogy power pool Trustee for a ‘trust’ identified by a trust or pool number for a pool share generated to your account which is not in strict compliance of the present Terms of Use and Service, your rights as a trust beneficiary for your share of said pool winnings may be compromised.


  4. Under the Age of Majority
    The Services are not intended for children under 18 years of age. No one under age 18 may provide any information to, on, or through the Services. We do not knowingly collect personal information from children under 18. If you are under 18, do not use or provide any information to the Services or on or through any of its features/register on the Services, make any purchases through the Services, use any of the interactive or public comment features of the Services or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 18 we will delete that information. If you believe we might have any information from or about a child under 18, please contact us at support@trilogypowerpools.com


  5. Marketing
    You acknowledge and agree that TPP may send you email containing information about TPP Services, such as state lottery games and promotions, TPP Trust ‘Pools’ as well as notifications pertaining to your Account activity. You may opt-out of promotional emails by following the opt-out instructions in the emails. However, we will still contact you regarding administrative matters concerning your Account. If you provide any information that is inaccurate or not current, or TPP has reasonable grounds to suspect that such information is inaccurate or not current, or you cannot be reached within 90 days for any reason, TPP reserves the right to suspend or cancel your Account, withhold your Account balance, revoke your right as a beneficiary of any ‘Pool’ or corresponding revenue distribution therefrom, and refuse any and all current or future use of the Application (or any portion thereof).


  6. Information We Collect About You and How We Collect It
    We collect personal information you provide to us, or that we receive from third parties, social media platforms, and other publicly available sources. The information we collect includes:

    1. Contact and Profile Data, such as name, email address, phone number, physical address, and date of birth.
    2. Account Data, such as the username and password you provide to set up an account with us. If you choose to login to the Services via a third-party platform or social media network, we may collect information from that platform or network.
    3. Government-issued Identification Numbers, such as a copy of your, driver’s license and/or state identification card, including your photo or identification number, and associated information.
    4. Payment Data, such as credit or debit card, or bank account number and routing number for the purposes of processing transactions at your request. We do not store your complete banking account number or payment card number.
    5. Financial Data, such as information about your financial accounts which may include the bank you are using, account type (checking or savings), and we may query and/or receive the current balance of each account at any point.
    6. Location Data, including the GPS location associated with your device.
    7. Feedback Data, such as information you provide and content that you upload when you contact us with questions, feedback, upload attachments, or otherwise correspond with us online or otherwise (including on our social media pages).
    8. Automatically Collected Data. We, our service providers and third-party advertising partners use cookies, web beacons/GIFs, pixel tags, embedded scripts, e-tags/cache browsers and other tracking technologies to automatically log information about you, your computer or mobile device, and your activity over time on the Services and other online services, including:
    9. Device Data, such as your computer or mobile device operating system type and version number, manufacturer and model, unique device identifier, browser type and version, screen resolution, the IP address used to connect your device to the internet, device identifier (such as the Google Advertising ID or Apple ID for Advertising), time zone setting, session time, browser plug-in types and versions, the website you visited before you visited our Services and location information such as city, state or geographic area, the number of times you click a page/screen or use a feature, the date and time you click on a page/screen or use a feature, and the amount of time you spend on a page or use a feature.
    10. Online Activity Data, such as browsing history, search history, and whether you clicked on or opened one of our emails. We also collect information about your visit, including the full Uniform Resource Locators (URL) clickstream to, through and from the Services (including date and time), search terms entered, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page. Please note that TPP does not respond to web browsers’ “do not track” signals or other opt-out mechanisms that indicate a request to disable online tracking of users who use our Services.


  7. Information We Receive From Third Parties
    1. We work with third parties to provide you the Services (including, for example, business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers, credit reference agencies) and may receive information about you from them. The information we collect from you may be combined with information from outside records (e.g., demographic information, navigation information, and/or additional contact information) that we have acquired in accordance with the law.
    2. We use Authorize.net to gather end user data from financial institutions. By using our Services, you grant TPP and Authorize.net the right, power, and authority to act on your behalf to access and transmit your personal and financial information from the relevant financial institution to our App. You agree to your personal and financial information being transferred, stored, and processed by Authorize.net in accordance with the Privacy Policy.
    3. We use BANK________________ for the purposes of processing ACH deposit transactions. By requesting an ACH payment transaction you agree to your personal and financial information being transferred, stored and processed by BANK ___________________ in accordance with the Privacy Policy.
    4. In addition to the above, we may need to verify your identity before we can permit you to use some features of the Services.
    5. We use IDAnalyzer.com for purposes of verification; we may also collect from you other information as may be required to verify your identity and/or location in accordance with applicable laws and regulations. This can include date of birth and address verification stored and processed by IDAnalyzer.com in accordance with the IDAnalyzer.com Privacy Policy.


  8. Information You Provide to Us
    The information we collect on or through our Services include:

    1. Information that you provide by filling in forms on our Services. This includes information provided at the time of registering to use our Services, subscribing to our service, or requesting further services. We may also ask you for information when you report a problem with our Services.
    2. Records and copies of your correspondence (including email addresses), if you contact us.
    3. Your responses to surveys that we might ask you to complete for research purposes.
    4. Details of transactions you carry out through our Services and of the fulfillment of your use of our services. You will be required to provide financial information when registering to use our Services.
    5. Your payment credentials including the primary account number, card holder name and expiration date, last 4-digit from card on file. (“Credentials on File”)
    6. Your search queries on the Services.


  9. Data Security
    We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Services. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on TPP Progressive Web App or Website.


  10. Information We Collect Through Automatic Data Collection Technologies
    As you navigate through and interact with our Services, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

    1. Details of your visits to and use of our Services, including traffic data, location data, logs, and other communication data and the resources that you access and use through the Services.
    2. Information about your computer and internet connection, including your IP address, operating system, and browser type.
    3. The information we collect automatically is statistical data and does not include personal information, but we may maintain it or associate it with personal information we collect in other ways or receive from third parties. It helps us to improve our Services and to deliver a better and more personalized service, including by enabling us to:

      1. Estimate our audience size and usage patterns.
      2. Store information about your preferences, allowing us to customize our Services according to your individual interests.
      3. Speed up your searches.
      4. Recognize you when you return to use our Services.
      5. Verify your location


    The technologies we use for this automatic data collection may include:

Pages of our the Website may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit TPP, for example, to count users who have visited those pages or and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).
    3. 3rd Party Analytics. We may use 3rd Party Analytic tools such as "Google Analytics and Quick-Site" to collect information about use of this TPP Progressive Web App and Website. 3rd Party Analytics collects information such as how often users visit this TPP Progressive Web App and Website, what pages they visit when they do so, and what other sites they used prior to coming to this TPP Progressive Web App and Website. We use the information we get from the 3rd Party Analytics only to improve this TPP Progressive Web App and Website. 3rd Party Analytics collects only the IP address assigned to you on the date you visit this TPP Progressive Web App and Website, rather than your name or other identifying information. We do not combine the information collected through the use of any 3rd Party Analytics with personally identifiable information. Although 3rd Party Analytics plants a permanent cookie on your web browser to identify you as a unique user the next time you visit this TPP Progressive Web App and Website, the cookie cannot be used by anyone but TPP’s 3rd Party Analytics. All 3rd Party Analytics’ ability to use and share information collected by 3rd Party Analytics about your visits to this site is restricted by the 3rd Party Analytics Terms of Use and the Privacy Policy. You can prevent 3rd Party Analytics from recognizing you on return visits to this site by disabling cookies on your browser.

      We do not collect personal information automatically, but we may tie this information to personal information about you that we collect from other sources or you provide to us.

    We use information that we collect about you or that you provide to us, including any personal information:

    1. To present our Services and their contents to you.
    2. To identify and authenticate your access to the Services.
    3. To provide you with information, products, or services that you request from us.
    4. To fulfill any other purpose for which you provide us.
    5. To provide you with notices about your account.
    6. To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
    7. To notify you about changes to our TPP Progressive Web App and Website or any products or services we offer or provide through it.
    8. To improve and troubleshoot our Services.

    10. To enable subsequent purchases initiated by you to pay for your monthly subscriptions (“Customer Initiated Transactions”) and to enable subsequent purchases initiated by us to pay for your Subscription Fees (“Merchant Initiated Transactions”)
    11. For any other purpose with your consent.


  12. Disclosure of Your Information
    We may disclose aggregated information about our users, and information that does not identify any individual, without restriction, we may disclose personal information that we collect or you provide as described in this privacy notice:

    1. To our subsidiaries and affiliates.
    2. To contractors, service providers, and other third parties we use to support our business.
    3. IDAnalyzer.com - We may use (IDAnalyzer.com) for age verification tasks. More information about IDAnalyzer.com data practices may be found here: IDAnalyzer.com.
    4. Authorize.net – We use (Authorize.net) Payments for many of our payment processing tasks. More information about Authorize.net data practices may be found here: Authorize.net.
    5. Arcgis.com – We use (Arcgis.com) to verify geographic location in order to comply with our rules. More information about Arcgis.com data practice may be found here: Arcgis.com.
    6. To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of TPP's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by TPP about our Services users is among the assets transferred.
    7. To fulfill the purpose for which you provide us.

    With your consent we may also disclose your personal information:

    1. For any other purpose disclosed by us when you provide the information.
    2. To comply with any court order, law, or legal process, including responding to any government or regulatory request.
    3. To enforce or apply our Terms of Use and Service, our Pool Terms and Revenue Sharing Trust Agreement, Privacy Policy and other agreements, including for billing and collection purposes.
    4. If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of TTP, our customers, or others.


  13. Choices About How We Use and Disclose Your Information
    We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

    Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of the Services may then be inaccessible or not function properly, including your ability to browse our site, App, subscribe to use or use our services.


  14. Accessing and Correcting Your Information
    You can review and change your personal information by logging into the Services and visiting your account profile page. You may also send us an email at support@trilogypowerpools.com to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.


  15. Promotional Offers from TPP
    If you do not wish to have your contact information used by TPP to promote our products or services, you can opt-out by logging into the TPP Progressive Web App and adjusting your user preferences in your account profile. If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. This opt out does not apply to information provided to TPP as a result of a subscription payments, service experience, or other transactions.


  16. Other Privacy Rights
    1. You may object to the processing of your personal information. Your objection, without further action, imposes no obligation on TPP.
    2. You may request correction of your personal data if it is incorrect or no longer relevant, or ask to restrict the processing of the information.
    3. You can designate an authorized agent to make a request under the CCPA on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with the CCPA.
    4. You may request to opt out from us collecting your information. Upon receiving an opt-out request, we will act upon the request as soon as feasibly possible, but no later than fifteen (15) days from the date of the request submission.
    5. You may request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Note; We DO NOT disclose personal information gathered through the Services or the TPP Progressive Web App to third parties for their direct marketing purposes.

    To exercise these rights, you can contact us by submitting a data subject access request, by emailing support@trilogypowerpools.com, or by referring to the contact details at the bottom of this document. If you have a complaint about how we handle your data, we would like to hear from you.


  17. Right to Request the Deletion of Personal Information
    You can ask us to delete the personal information that we have collected from you, subject to certain exceptions. We will also notify any service providers and third parties with whom we have shared your personal information of your request. Please note that due to applicable laws and regulations, you will be unable to use some of our Services if your personal information is deleted, including, but not limited to, ordering lottery tickets. As noted above, your deletion request is subject to certain exceptions which we may rely on where it is necessary for us to:

    1. Complete the transaction for which the personal information was collected, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us;
    2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity;
    3. Debug to identify and repair errors that impair existing intended functionality;
    4. Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law;
    5. To enable solely internal uses that are reasonably aligned with the expectations of the consumer based on the consumer’s relationship with us;
    6. Comply with a legal obligation; or otherwise use the personal information, internally, in a lawful manner that is compatible with the context in which you provided the information

    It is our policy to post any changes we make to our privacy notice on this page. If we make material changes to how we treat our users' personal information, we will notify you by email to the email address specified in your account and through a notice on the TPP Progressive Web App or Website home page. The date the privacy notice was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our Website and this privacy notice to check for any changes. By continuing your use of our Website and/or the TPP Progressive Web App after delivery of such notice via the Website, the TPP Progressive Web App, or through your email you consent to any such changes to our privacy notice.

    We are not a social network ourself, but we may provide links to social media sites to facilitate sharing with such sites. Your use of such links as it your own risk and discretion.

    When you interact with our Services through social media sites, plug-ins or other applications, depending upon your privacy settings, you should be aware that this information may become public on the Internet. We cannot prevent or control further use of this information. You can control what data you share through privacy settings available on some social media sites. Please refer to those third-party sites’ privacy policies and terms of use to learn more about their privacy practices, which we do not control.

    Our Services may, from time to time, contain links to and from the websites of others, including our partners, advertisers, and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. You should check these policies before you submit any personal data to these websites


  21. User Restrictions
    The Services are hosted in the United States and are intended for and directed to users in certain states in the United States. As of April 15th 2024, this offer is only applicable to residence of the state of Arizona, USA. If you access the Services from European Union, Asia, or any other region with laws or regulations governing personal data collection, use, and disclosure, that differ from United States laws, please be advised that through your continued use of the Services, which are governed by U.S. law, this Privacy Policy, our Terms of Use and Service and our Pool Terms and Revenue Sharing Trust Agreement, you acknowledge that you are transferring your personal information to the United States and you consent to that transfer. You further consent to the collection and/or processing in the United States of your personal information and tracking technologies/cookies as described in this Privacy Policy. Please note that we restrict transactions through our Services to certain states in the United States. Use of the Services in certain jurisdictions may be restricted by the laws those jurisdictions regardless of residency; it is your sole responsibility to comply with applicable law, and in using the Services you agree that TPP is not liable for your use of the Services in contravention of the laws of the jurisdiction in which you access said Services


  22. Right to Ask Us Not to Sell Your Personal Information
    We do not sell your personal information. However, like many companies, we may use advertising services that try to tailor online ads to your interests based on information collected via cookies and similar technologies about your online activity. This is called interest-based advertising. The CCPA’s statutory definition of the term “sale” is broad and may include interest-based advertising. You can get more information and opt-out of the use of cookies on our Services for interest-based advertising purposes by setting your preferences on the TPP Progressive Web App or our website. You will need to set your preferences from each device and each web browser from which you wish to opt-out. This feature may use a cookie to remember your preference, so if you clear all cookies from your browser, you may need to reset your settings.


  23. Changes and Updates
    This Privacy Policy may be periodically revised, and this will be reflected by the “Last update” date at the top. Please revisit this page to stay aware of any changes. If a revision to this Privacy Policy, in our sole discretion, is material, we will notify you by contacting you through the email address associated with your account and/or we may provide notice to you within the TPP Progressive Web App itself where we may require you to acknowledge such changes. For non-material changes, where your acknowledgement is not required, your continued use of the Services constitutes your acceptance of the Policy as amended. Each time you use the Services, the version of our Privacy Policy then posted will apply to that use, so it is your responsibility to check for updates each time you access the TPP Progressive Web App or the Services.

    To the extent any provision of this Privacy Policy is found by a competent tribunal to be invalid or unenforceable, such provision shall be severed to the extent necessary for the remainder to be valid and enforceable.

    In the event TPP, a substantial part of its assets, or all its assets are acquired, customer information (including your personal information) may be one of the transferred assets. Therefore, we may disclose and transfer your personal information and other data to a subsequent owner, co-owner or operator of TPP or the Services, or in connection with a merger, consolidation, restructuring, the sale of substantially all of our interests or assets, or other corporate change (including in the event of a dissolution or bankruptcy), and in all cases, this may include sharing the information with prospective purchasers, investors, trustees, or other involved parties as part of the due diligence or acquisition or transfer processes, in connection with court proceedings, or in connection with financial transactions that TPP may be involved in, such as obtaining investors or financing.
